1 Acceptance of Terms

By accessing or using homes.realtychatter.com (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use this Site.

These Terms form a legally binding agreement between you and the operator of this Site, Gary A. McGowan, REALTOR®, Keller Williams Realty Centres, Brokerage, operating in Ontario, Canada.

This Site is operated by a licensed real estate professional and is designed to:

• Generate real estate leads and facilitate connections between consumers and real estate professionals
• Showcase real estate technology tools and services available to other real estate professionals
• Provide information about GoHighLevel (GHL) CRM integration and related marketing automation solutions

3 Eligibility

You must be at least 18 years of age to use this Site. By using the Site, you confirm you meet this requirement and have the legal capacity to enter into binding agreements in your jurisdiction.

5 Lead Generation & Contact

When you submit your contact information through this Site, you expressly consent to being contacted by us or affiliated real estate professionals via telephone (including automated calls and text messages), email, or other electronic means, in accordance with Canada's Anti-Spam Legislation (CASL) and applicable provincial regulations.

You may withdraw consent to receive commercial electronic messages at any time by contacting us directly or using the unsubscribe mechanism in any message we send.

6 Anti-Spam Compliance (CASL)

We comply with Canada's Anti-Spam Legislation (S.C. 2010, c. 23). Any commercial electronic messages we send will:

• Clearly identify us as the sender
• Include our contact information and mailing address
• Include a functional unsubscribe mechanism
• Be sent only with your express or implied consent as defined under CASL

Unsubscribe requests will be processed within 10 business days.

7 Intellectual Property

10 Limitation of Liability

To the maximum extent permitted by applicable law in Ontario, Canada, RealtyChatter / Gary A. McGowan, his representatives and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or connected with your use of, or inability to use, this Site.

This includes, without limitation, damages for loss of profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of this Site shall not exceed one hundred Canadian dollars (CAD $100.00).

11 Indemnification

You agree to indemnify and hold harmless RealtyChatter / Gary A. McGowan and his representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, or your violation of these Terms.

12 Privacy

Your use of this Site is also governed by our Privacy Policy, incorporated into these Terms by reference. By using this Site, you consent to the collection, use, and disclosure of your personal information as described in that policy.

13 Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

14 Modifications

We reserve the right to update or modify these Terms at any time without prior notice. Changes are effective upon posting to this Site. The effective date at the top of this page reflects when the Terms were last updated. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
